Sample Consent for Clinical Photos

The online version of the April e-HIM Best Practices column “Using Clinical Photos in EHRs” includes a sample consent form for clinical photography, videotaping, audiotaping, and other multimedia imaging of patients.

The inclusion of clinical photographs within the legal health record is an individual decision that each organization must make after consulting with legal counsel. The decision to include clinical photos as a part of the health record should not be entered into lightly; this is an important issue for medical teaching, research, and quality patient care.

HIM professionals have a duty to protect patient privacy, security, and confidentiality and should be closely involved in their organization’s decision to include or exclude clinical photos in the legal health record.
